In this action to recover damages for injuries sustained as a consequence of a sustained pattern of school bullying, the Appellate Division, Second Department, in accordance with Horn Appellate Group’s arguments on appeal, reversed the motion court’s order and deemed the Notice of Claim to have timely served nunc pro tunc, holding that the school district had actual and timely knowledge of the facts constituting the claim and thus was not prejudiced by the late notice of claim.
