In this personal injury action, the Appellate Division, Second Department, in accordance with M&H’s arguments on appeal, reinstated Plaintiff’s Complaint, finding that service had been timely made nunc pro tunc, and that any change of venue must be predicated upon the waiver of a statute of limitations defense in the new forum.
