In this action to recover damages for personal injuries sustained in the stairwell of a Nassau County apartment complex, the Appellate Division, Second Department, in accordance with M&H’s arguments on appeal, reversed the lower court’s order dismissing the complaint, finding that evidence of the landowner’s general cleaning and inspection practices failed to demonstrate a prima facie lack of constructive notice.
