In this breach of contract action, stemming from a “Life Rights Agreement,” between rapper Curtis Jackson, a/k/a 50 Cent, and a former romantic partner, the Appellate Division, First Department, in accordance with Horn Appellate Group’s arguments on appeal, determined that Plaintiff, G-Unit Books, was not entitled to a default judgment and Defendant, Shaniqua Tompkins, was entitled to to an extension of time to answer the complaint, finding that the brief delay, the reasonable excuse and the absence of prejudice militated in favor of permitting the matter to be litigated on the merits.
