In this action to recover damages for injuries sustained in an elevator accident, the Appellate Division, First Department, in accordance with Horn Appellate Group’s arguments on appeal, reversed the lower court in finding that the building owner was entitled to conditional summary judgment on its contractual indemnification claim based upon the indemnity provision within the elevator service contract.
