In this action to recover damages for injuries sustained in a construction accident, the Appellate Division, Second Department, in accordance with Horn Appellate Group’s arguments on appeal, reversed the lower court’s award of summary judgment in favor of the defendant and reinstated Plaintiff’s Labor Law 200 and common-law negligence claims, holding that triable issues of fact exist as to whether the injury-producing hazard was inherent in the work he was hired to perform.
