In this action to recover damages under the Child Victim’s Act, the Appellate Division, Second Department, in accordance with Horn Appellate Group’s arguments on appeal, held that Plaintiff was entitled to the production of “all documents concerning sexual abuse perpetrated at Mount Loretto by persons other than [the accused] prior to the alleged abuse of the plaintiff” because such discovery was material and necessary to the prosecution of the action.
