In this action to recover damages for serious personal injuries sustained after being rear-ended by a heavy construction vehicle, the Appellate Division, Third Department, in accordance with Horn Appellate Group’s arguments on appeal, held that the defendant was not entitled to summary judgment as there were triable issues of fact concerning whether obligations imposed under the Vehicle & Traffic Law required him to proceed at a rate of speed below the speed limit as he traversed the roadway curve in question.
