In this medical malpractice action, the Appellate Division, Second Judicial Department, in accordance with Horn Appellate Group’s arguments on appeal, reversed the order awarding summary judgment to Defendants and reinstated the action, finding that Plaintiffs’ expert submission raised a triable issues of fact regarding Defendants’ departures from the accepted standard of care and causation of the Infant Plaintiff’s injuries.
