In this action for workplace injuries sustained as a consequence of Labor Law violations at LaGuardia Airport’s Delta Airlines terminal, the Appellate Division, First Department, in accordance with Horn Appellate Group’s arguments on appeal, vacated the award of summary judgment in favor of the defendants and reinstated Plaintiff’s Labor Law sec. 241(6) and 200 causes of action, holding that [i] defendants had failed to establish prima facie that they had not violated the Labor Law by providing an unsecured ramp for the movement of heavy construction materials (citing Industrial Code sec. 23-1.22(b)(1)], and [ii] questions of fact abound regarding Delta’s control over the work and the defendants’ role in causing the plaintiff’s injuries.
