In this action to recover damages for medical malpractice and wrongful death, the Appellate Division, Second Department, in accordance with Horn Appellate Group’s arguments, determined that Plaintiff was entitled to renewal and denial of Defendants’ dismissal motion, finding that Plaintiff had a reasonable excuse for not presenting restored Letters of Administration in the initial motion practice.
