Employee Of Kings County Pharmacy In this action to recover damages for defamatory statements made by a former employee of a Brooklyn Pharmacy, the Appellate Division, Second Department, in accordance with Horn Appellate Group’s arguments on appeal, reversed the lower court’s order and reinstated the defamation claims, holding that the statements were not protected by either the common law litigation privilege or the statutory privilege afforded by New York Civil Rights Law sec. 74.
