In this action for declaratory relief concerning control of a Brooklyn congregation, the Appellate Division, Second Department, in accordance with Horn Appellate Group’s arguments on appeal, determined that the “law of the case” doctrine precluded the defendant from seeking dismissal of claims seeking to nullify and void an amended certificate of incorporation, which was alleged to have been fraudulently obtained and filed.
