In this action to recover damages for personal injuries, the Appellate Division, Second Judicial Department, in accordance with M&H’s arguments, vacated the challenged provision of an order of the Supreme Court, Kings County, finding that medical authorizations related to pre-existing injuries were “material and necessary” to the defense in the action and directing that Plaintiff’s obligation to furnish those authorizations was “without condition.”
