In this action to recover damages for wrongful death, the Appellate Division, Second Department, in accordance with our arguments on appeal, reversed the lower court’s dismissal of the underlying action and reinstated the complaint, reinforcing the burden of proof borne by a moving defendant seeking to win a pre-answer dismissal predicated upon an affirmative defense of statutory immunity under New York’s Emergency or Disaster Treatment Protection Act [“EDTPA”].
