In these post-trial appeals, challenging two separate jury verdicts rendered on liability and damages, the Appellate Division, Second Department, in accordance with arguments made by the Horn Appellate Group, reversed the Judgment in favor of the plaintiff and ordered new trials on both liability and damages, inter alia, finding that the jury charge had erroneously conflated the duties of the two co-defendants and the $2.64 million in damage awards were both excessive and unsupported by competent evidence.
