In this action to recover damages for medical malpractice and wrongful death, the Appellate Division, Second Department, in accordance with the Horn Appellate Group’s arguments on appeal, reversed the lower court and determined that Plaintiff was entitled to engage the savings cause of CPLR 205(a) more than once during the pendency of the issuance of letters of administration.
