In this action to recover damages for injuries sustained as a result of a failed orthopedic ankle implant, the Appellate Division, First Department, in accordance with Horn Appellate Group’s arguments on appeal, reversed the lower court’s order and granted Plaintiff’s request for an extension of the note of issue filing deadline, finding that the delays in completing discovery stemmed from legitimate difficulties encountered by both sides during discovery.
